Welcome to Cozy Cabaret! We’re glad you’re here. These Terms and Conditions (“Terms”) explain the rules for using our website and buying from us. We’ve tried to keep them clear and readable, but they are a legal agreement, so please read them carefully.

1. About us and these Terms

This website, cozycabaret.com (the “Site”), is operated by Ledet Commerce LLC, doing business as Cozy Cabaret (“Cozy Cabaret,” “we,” “us” or “our”). Throughout these Terms, “you” means anyone who visits the Site or places an order with us.

By visiting the Site or buying from us, you agree to these Terms and to the policies they refer to, including our Shipping Policy, Return & Refund Policy and Privacy Policy. If you don’t agree, please don’t use the Site.

Our store is hosted on Shopify Inc., which provides the online platform that lets us sell our products to you.

2. Who can use the Site

You must be at least 18 years old, or the age of majority where you live, to place an order. By placing an order you confirm that you meet this requirement and that the information you give us is true and complete.

We currently sell and ship only to addresses within the United States. See our Shipping Policy for details, including address types we can’t deliver to.

3. Products and descriptions

We work hard to show our products accurately, with clear photos, real sizes and honest descriptions. Even so:

  • Colors can look different depending on your screen, and handmade or natural-material pieces can vary slightly from item to item.
  • Measurements and weights are approximate.
  • Our products are made and shipped by trusted partner suppliers and warehouses. Product packaging, labels and packing slips may show a supplier’s details rather than ours.

If an item arrives damaged, defective or different from what you ordered, our Return & Refund Policy explains how we’ll make it right.

4. Prices and availability

All prices are shown in U.S. dollars. Prices, products and promotions can change at any time without notice, and items are available only while supplies last.

Sales tax, where it applies, and shipping charges are calculated and shown at checkout before you pay.

Occasionally the Site may contain a typo or error in a price, description or availability. We reserve the right to correct any error and to cancel any order affected by it, even after you’ve placed it. If we cancel an order you’ve already paid for, we’ll refund you in full.

5. Orders and payment

When you place an order, you’ll receive an email confirming we’ve received it. That confirmation is not our acceptance of your order. Your order is accepted when we ship it.

We may refuse or cancel any order, or limit quantities, for any reason, including suspected fraud, unauthorized or reseller purchasing, or problems with payment or address details. If we cancel an order after you’ve been charged, we’ll refund you in full.

Payments are processed securely at checkout through Shopify and our payment providers. You agree to provide current, complete and accurate billing and account information, and you confirm you’re authorized to use the payment method you provide.

6. Discount codes and promotions

Discount codes and promotions are subject to any terms shown with them, can’t be exchanged for cash, and generally can’t be combined unless we say so. We may end or change a promotion at any time, and we may cancel orders that use a code in a way we didn’t intend.

7. Shipping

Shipping rates, processing times, delivery estimates and what to do about lost, late or damaged packages are explained in our Shipping Policy, which is part of these Terms. Delivery times are estimates, not guarantees.

Title to and risk of loss for items pass to you when the carrier delivers them to the shipping address you provided. Please double-check your address at checkout, since we can’t be responsible for orders sent to an address that was entered incorrectly.

8. Cancellations, returns and refunds

You may cancel an order by contacting us within 12 hours of placing it. After that, or once an order has shipped, it can’t be canceled, but you can return it once it arrives.

Returns, refunds and exchanges are covered by our Return & Refund Policy, which is part of these Terms. In short, you can request a return within 30 days of delivery, and damaged, defective or wrong items must be reported within 7 days of delivery.

9. Your account and your information

If you create an account, you’re responsible for keeping your login details secure and for activity under your account. Please let us know right away if you think someone else has used it.

How we collect, use and protect your personal information is explained in our Privacy Policy.

10. Reviews, comments and messages

If you send us or post reviews, photos, comments, suggestions or other content, you confirm that it’s yours to share, that it’s accurate, and that it isn’t unlawful, offensive, misleading or harmful. You give us a non-exclusive, royalty-free, worldwide license to use, display, edit and share that content in connection with Cozy Cabaret, including on the Site and in our marketing. We may remove any content at our discretion.

11. Acceptable use

When using the Site, you agree not to:

  • Break any law or encourage anyone else to.
  • Copy, scrape, sell or misuse the Site or its content.
  • Interfere with the Site’s security or operation, or upload viruses or harmful code.
  • Pretend to be someone else, or give us false information.
  • Harass, abuse or harm others, or use the Site for spam or fraud.

We may suspend or end your access to the Site if you break these Terms.

12. Our content

Our name, logo, text, graphics, page designs and other content created by us are owned by or licensed to Cozy Cabaret and protected by intellectual property laws. You may view and share the Site for personal, non-commercial use, but you may not copy, reproduce or reuse our content for any other purpose without our written permission.

13. Links to other websites

The Site may link to websites run by others, such as carrier tracking pages. We don’t control those sites and aren’t responsible for their content, products or practices. Please review their terms and policies before using them.

14. Disclaimer

Except as stated in our Return & Refund Policy and where the law says otherwise, the Site and our products are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the Site will always be available, uninterrupted or free of errors.

Some states don’t allow certain warranties to be excluded, so some of the above may not apply to you.

15. Limitation of liability

To the fullest extent allowed by law, Cozy Cabaret and its owners, employees, suppliers and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Site or our products.

Our total liability for any claim related to an order or the Site is limited to the amount you paid for the product that gave rise to the claim.

Some states don’t allow these limitations, so some of the above may not apply to you. Nothing in these Terms limits any rights you have under consumer protection laws that can’t be waived.

16. Indemnification

You agree to cover and protect Cozy Cabaret and its owners, employees, suppliers and service providers from any claims, losses or costs, including reasonable legal fees, that arise from your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of others.

17. Resolving problems

If something goes wrong, please contact us first. Most issues can be sorted out quickly and kindly, and we’ll do our best to make it right. If we can’t resolve a dispute informally within 30 days, either of us may pursue it as described below.

18. Governing law

These Terms are governed by the laws of the State of Louisiana and applicable U.S. federal law, without regard to conflict-of-law rules. Any legal action relating to these Terms or the Site will be brought in the state courts located in Terrebonne Parish, Louisiana, or the federal courts for the Eastern District of Louisiana, except that either of us may bring a qualifying claim in small claims court.

19. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll post the new version here and change the “Last updated” date above. Changes apply to orders placed after the update is posted. Continuing to use the Site after a change means you accept the updated Terms.

20. Other legal details

  • If any part of these Terms is found to be unenforceable, the rest stays in effect.
  • If we don’t enforce a part of these Terms right away, we can still enforce it later.
  • These Terms, together with the policies they link to, are the entire agreement between you and us about the Site and your purchases.
  • We aren’t responsible for delays or failures caused by events outside our reasonable control, such as severe weather, carrier or supplier disruptions, or natural disasters.
